Agreement to Terms
By accessing and using DeSmit's Heating & Cooling's website and services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
Services
DeSmit's Heating & Cooling provides HVAC (Heating, Ventilation, and Air Conditioning) services including but not limited to:
- Installation of heating and cooling systems
- Repair and maintenance services
- Emergency repair services
- System inspections and tune-ups
- Indoor air quality solutions
Service Appointments
When scheduling service appointments:
- We will provide an estimated time window for service calls
- Customers must provide access to the service area
- Payment is due upon completion of services unless other arrangements are made
- Cancellations should be made at least 24 hours in advance
Pricing and Payment
All pricing is subject to change without notice. We will provide written estimates for work over a certain amount. Payment terms are as follows:
- Payment is due upon completion of services
- We accept cash, check, and major credit cards
- Financing options may be available for larger projects
- Late payment fees may apply to overdue accounts
Warranties
We stand behind our work and provide warranties as follows:
- Labor warranty on installations as specified in service agreements
- Equipment warranties are provided by manufacturers
- Warranties do not cover damage caused by misuse, neglect, or normal wear
- Warranty claims must be reported promptly
Limitation of Liability
DeSmit's Heating & Cooling's liability for any claims arising from our services shall not exceed the amount paid for the specific service in question. We are not liable for:
- Consequential or incidental damages
- Damage to property not directly related to our work
- Issues arising from pre-existing conditions not disclosed
- Delays due to circumstances beyond our control
Emergency Services
Emergency services are available 24/7 for urgent HVAC issues. Emergency service rates may apply outside normal business hours. We will provide an estimate for emergency repairs when possible.
Permits and Compliance
We are licensed and insured. All work is performed in compliance with local building codes and regulations. We will obtain necessary permits for work requiring them.
Customer Responsibilities
Customers are responsible for:
- Providing clear access to work areas
- Disclosing any known issues or previous repairs
- Following maintenance recommendations
- Notifying us of any warranty issues promptly
Dispute Resolution
Any disputes arising from our services will be resolved through good faith negotiation. If resolution cannot be reached, disputes may be subject to binding arbitration in accordance with Illinois state law.
Changes to Terms
We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting on our website. Continued use of our services constitutes acceptance of modified terms.
